Privacy Policy

Data protection is very important to us, so we take due care to ensure that personal data is processed securely. Personal data will be used in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and in accordance with Act No. 18/2018 Coll. on data protection and on amendment and supplementation of certain acts and in accordance with the principles set out below.

1. Introduction

This Data Protection Policy provides you with all the necessary information regarding data processing, in particular when using the Intermarketing Website, which serves as the central platform for information, communication and interaction with Intermarketing s.r.o. customers and fans in the Slovak Republic. Access to and use of the content of the Intermarketing Web Site is subject to this Privacy Policy as well as all other applicable laws, regulations and rules. By continuing to use the Intermarketing Web Site, you acknowledge that you accept this Privacy Policy.

2. Data controller and contact details of the data protection officer

The operator is the company Intermarketing s.r.o., Šaštínska 38, Bratislava. You can contact the person responsible for the protection of personal data of Intermarketing in connection with all questions concerning the processing of your personal data and the exercise of your rights by e-mail: ahoj@intermarketing.sk.

3. Description of the services, categories of data, purposes and legal basis of data processing, categories of data recipients and transfer of personal data to third countries

3.1. Supplier-customer relations

On the basis of a pre-contractual and contractual relationship to which you are a party within the meaning of Article 6(1)(b) of the Regulation and also on the basis of the legitimate interest of the company within the meaning of Article 6(1)(f) of the Regulation, we process your personal data, in particular in the context of supply and customer contracts. We obtain personal data either directly from you, if you are a person authorised to act on behalf of the company with which we enter into a contractual relationship, or from your employer, as data necessary to ensure contact, in connection with the performance of the subject matter of the contract. We retain your personal data for the duration of the contractual relationship and then for archiving purposes for a period of 10 years from the expiry of the contract.

3.2. Bookkeeping

We may also process the data for the purposes of fulfilling the company’s accounting obligations under Article 6(1)(c) of the Regulation (in particular the obligations arising from Act No.431/2002 Coll. on accounting, as amended, Act No. 222/2004 Coll. on value added tax, as amended). We keep your personal data contained in accounting records/invoices for 10 years following the year to which these accounting records/invoices relate.

3.3. Marketing, advertising, survey activities of the Operator and satisfaction surveys

We may also process your personal data on the basis of your consent within the meaning of Article 6(1)(a) of the Regulation for the purpose of marketing, advertising and research activities, in particular for the purpose of ascertaining customer satisfaction and offering goods and services by any means, including calling, sending e-mail messages and short message services. Such consent is always at your free choice and is always obtained separately. Personal data is processed for a period of 5 years from the date of consent or, if earlier, until consent to such processing is withdrawn.

3.4. Events, competitions and promotions

We also process your personal data on the basis of consent within the meaning of Article 6(1)(a) of the Regulation. Participants of activities organized by Intermarketing s.r.o. for its customers and/or fans, by their participation in these activities, grant the organizer or the technical implementer of the organizer consent that the organizer or the technical implementer is entitled to use the first name, surname and to make recordings of the participant’s likeness and other visual and audio recordings of the participant for the purpose of implementation and/or promotion before, during or after the activity free of charge and to publish and disseminate them in the mass information media and promotional materials (including electronic). In the case of a competition, the above consent also applies, inter alia, to the prize, its handing over to the participant and its use by the participant. Consent to the processing of personal data is granted for a limited period of time for the duration of the event, competition and promotion, as well as for the necessary period for their evaluation or the handing over of prizes in the case of a competition, and subsequently for a period of 24 months for the promotion of the event and the Salestuning brand, or for the period of time specified in the consent form that you sign separately. Once this purpose has been fulfilled, the participant’s personal data will be destroyed and will no longer be used. Consent may be withdrawn at any time in writing at the address of the Operator or by sending an e-mail to the following e-mail address: ahoj@intermarketing.sk.

3.5. Website

The Intermarketing website offers opportunities for information, communication and interaction with Intermarketing in the Slovak Republic via the Internet. In this context, the following data may be collected, processed and/or used concerning your person, telephone number, e-mail address, status and date of any consent to contact you for marketing and market research purposes,
Your personal data will be processed primarily within the meaning of Article 6, para. 1, lit. b) The Intermarketing Website’s Terms of Service, your personal data may also be disclosed to entities in third countries in order for you to use some of the Intermarketing Website’s features, if you so wish, and for analytical purposes (see section 3.2 for details). These entities are:

  • Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA
  • YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA
  • The transfer of data to Google Inc. and Youtube LLC will be secured by the EU-US Privacy Shield Framework Agreement.

3.5.1. Operating and improving our website

Operating and improving our website, such as making the website accessible; displaying content on our website; interacting with you on our website; improving the content and features of our website; understanding how you use our website; and server security and stability. Your personal data will be processed primarily within the meaning of Article 6, para. 1, lit. b) Regulation legitimate interests (Article 6(1)(f) GDPR) – the legitimate interest is the reasonable and efficient operation and development of our website.

3.5.2. Cookies

When you visit our website, we may use cookies and process related information for the purposes set out below. “Cookies” are small text files that may be transferred to your device (e.g. computer or smartphone) when you visit a website using a web browser or other programs. These are stored locally on your end device and ready for later retrieval. The information processed in connection with the use of cookies may be information about you, your preferences or your device (technical data; content and advertising data). We use Strictly Necessary Cookies to ensure the operation of our website, to provide them securely and to store information about your consent or refusal of Cookies (“Strictly Necessary Cookies”). The legal basis for the processing of your personal data in connection with such necessary cookies is our legitimate interest Your browser also allows you to delete stored cookies at any time.

4. Retention period of personal data

Your personal data will be stored and processed until the fulfilment of the purpose for which it was provided by you as described in the statutes above. In the case of registration for the website services, we will process personal data for the duration of your registration.

You can exercise your rights to request access (Article 15 of the GDPR Regulation), rectification (Article 16 of the GDPR Regulation), erasure (Article 17 of the GDPR Regulation) or restriction of processing (Article 18 of the GDPR Regulation) of your personal data, as well as the right to data portability (Article 20 of the GDPR Regulation), at any time by contacting Intermarketing s.r.o. or the data protection officer directly.
